2Quip Corp Rental Protection Plan (RPP)


At 2Quip Corp, we understand that accidents and unforeseen events can occur during equipment rentals. With construction equipment often valued at tens or hundreds of thousands of dollars, a single incident can significantly impact your business. Our Rental Protection Plan (RPP) is designed to limit your financial liability for damage, loss, or theft of rented equipment, provided you do not have independent property insurance covering the equipment. By opting into the RPP or if it is automatically applied due to the absence of a valid Certificate of Insurance (COI), you will be responsible for up to $1,000 per incident, subject to the terms and conditions outlined below. The RPP policy is capped at $10,000 per incident.



Scope of Coverage


The RPP is not insurance and does not cover liability for injury, damage to persons or property, or any other losses arising from the possession, use, or operation of the equipment. Coverage is limited to the replacement cost of the rented equipment and does not apply to on-highway equipment.


Subject to the conditions and exclusions below, the RPP caps your liability on the first $10,000 to owner for the following events:


Theft: $1,000 for stolen equipment.

Damage: $1,000 for repair costs due to damage.

Loss or Destruction: $1,000 for lost or destroyed equipment.


Damages or fees beyond the intial $10,000 may still be the responsibility of the renter to resolve.



Conditions for Coverage


The RPP applies only if all of the following conditions are met:


1. Payment of RPP Fee:

o 15% of the gross rental charges for standard equipment.

o 18% of the gross rental charges for equipment used in forestry or demolition.

2. Compliance: You fully comply with the terms of the RPP and the 2Quip Corp Rental Terms and Conditions, and any attached owner rental agreements.

3. Account Status: Your account with 2Quip Corp is current at the time of the incident.

4. No Exclusions: None of the exclusions listed below apply to the incident.

5. Proper Documentation: You provide all required documentation, including a valid rental agreement and any incident-related reports, within the specified timeframes.

6. Equipment Maintenance: You adhere to all manufacturer-recommended maintenance and operating procedures during the rental period.



Exclusions


The RPP does not cover incidents under the following circumstances, as determined by 2Quip Corp in its sole discretion after investigation:


1. Failure to Notify: You do not provide written notice (via email or text) of the incident to 2Quip Corp within 24 hours of its occurrence.

2. Lack of Cooperation: You fail to cooperate with 2Quip Corp or its agents during the investigation, including providing access to the incident site or relevant personnel.

3. Negligent Transport: Damage results from improper or negligent transportation of the equipment.

4. Misuse: Damage or loss results from using the equipment outside its intended purpose.

5. Vandalism or Hazardous Conditions: Damage results from vandalism, malicious mischief, or operation near fire sources or water hazards.

6. Violation of Rental Agreement: The incident results from use prohibited by the current 2Quip Corp Rental Agreement, whether or not signed by you.

7. Unreported Theft or Loss: Theft or loss is not reported to the police within 24 hours of discovery, or you fail to provide a written police report. You must also demonstrate reasonable efforts to secure the equipment (e.g., evidence of fencing, alarms, security, or surveillance).

8. Acts of God: Damage results from natural disasters, including tornadoes, floods, hail, wind, storms, or earthquakes.

9. Untrained Operators: The equipment is operated by an individual not properly trained for its use.

10. Tire/Track Damage: Damage to tires, tracks, or tubes results from blowouts, bruises, cuts, punctures, or other causes inherent to equipment use.

11. Unauthorized Modifications: Damage results from unauthorized modifications, attachments, or repairs to the equipment.

12. Overloading: Damage occurs due to exceeding the equipment’s rated capacity or specifications.

13. Subleasing: The equipment is subleased, transferred, or used by a third party without prior written consent from the owner of the equipment.



Recovery of Equipment


If lost or stolen equipment is recovered, 2Quip Corp or the equipment owner retains ownership of the equipment, regardless of any payments made by you or your insurance provider. All payments related to the incident are non-refundable.



Additional Terms


1. Termination of RPP: The RPP coverage terminates upon the return of the equipment to 2Quip Corp or the owner or the expiration of the rental period, whichever occurs first. Coverage does not extend to incidents occurring after this period.

2. Non-Transferable: The RPP is non-transferable and applies only to the renter named in the rental agreement.

3. Inspection Requirement: You must allow equipment owner to inspect the equipment before and after the rental period. Failure to permit inspection may void RPP coverage.

4. Dispute Resolution: Any disputes arising from the RPP will be resolved through mediation or arbitration in state of rental, as determined by owner, unless otherwise required by law.

5. Right to Deny Coverage: 2Quip Corp or owner reserves the right to deny RPP coverage if any misrepresentation or fraudulent activity is discovered in connection with the rental or incident.

6. Subrogation: If 2Quip Corp or owner covers a loss under the RPP, it reserves the right to pursue subrogation against any third party responsible for the incident to recover its costs.

7. Geographic Limitations: The RPP is valid only for equipment used within the United States. Use outside this region voids coverage.

8. Incident Documentation: You must provide photographic evidence and a detailed written description of the incident within 48 hours of its occurrence, in addition to the 24- hour notification requirement. It is required that pictures and comments are also documented in the 2Quip system.

9. RPP Fee Non-Refundable: The RPP fee is non-refundable, even if no incidents occur during the rental period.



How to Opt-In


To enroll in the RPP, select the RPP option during the rental process for the applicable rental period. If you do not provide a valid COI, the RPP may be automatically applied to your rental.
